אדם מבשור שהאדם משלם את הנזק ומשל׳ ומשלם
דמי ולדות ושור אינו משלם אלא נזק ופטור

עשה בהם חבורה והחובל בחבירו ביום ה
כפורים חייב בכולן. החובל בעבד עברי חייב
בכולן חוץ מן השבת בזמן שהוא שלו. ה
חובל .בעבד כנעני שלאחרים חייב בכולן ר׳ רבי
45 יהודה אומ׳ אומר אין לעבדים בשת:

שוטה וקטן פגיעתן רעה החובל בהן חייב והן
שחבלו באחרים פטורין העבד והאשה פגיעתן

מעשה באחד שפרע ראשה שלאשה ובאתה
לפני ר׳ רבי עקיבה וחייבו ליתן לה ארבע מאות זוז
אמ׳ אמר לו תן לי זמן נתן לו שימרה עומדת על פתח
40 חצרה ושיבר את הפך בפניה ובו כאיסר שמן ?
וגילת את ראשה והיתה מטפחת ומנחת על ראשה
והעמיד לה עדים ובא לפני ר׳ רבי עקיבה אמ׳ אמר לו ר׳ רבי
לזו אני נותן ארבע מאות זוז אמ׳ אמר לו לא אמרת
כלום שהחובל בעצמו אע״פאף על פי שאינו רשאי פטור
45 ואחרים שחבלו בו חייבין. הקוצץ את נטיעותיו
אע״פאף על פי שאינו רשאי פטור. ואחרים שקצצו את
נטיעותיו חייבין:
