נכסיו על פיו ר׳ רבי אליעזר אומ׳ אומר אחד בריא ואחד
5 מסוכן. נכסים שיש בהן אחריות נקנין ב
כסף ובשטר ובחזקה ושאין להן אחריות
אין נקנין אלא במשיכה. אמרו לו מעשה
באמן שלבני רוכל שהיתה חולה ואמרה
תנתן כבינתי לבתי והיא בשנים עשר מנה
10 ומתה וקיימו את דבריה אמ׳ אמר להן בני רוכל
תקברם אמם. וחכמ׳ וחכמים אומ׳ אומרים בשבת דבריו
קיימים מפני שאינו יכול לכתוב אבל לא
בחול. ר׳ רבי יהושע אומ׳ אומר בשבת אמרו קל וחו׳ וחומר
בחול. כיוצא בו זכים לקטן ואין זכין לגדול
15 ר׳ רבי יהושע אומ׳ אומר לקטן אמרו קל וחומ׳ וחומר לגדול:

ועל אביו ועל מורישיו והיתה עליו כתובת
30 אשה ובעלי חוב יורשי האב אומרי׳ אומרים הבן
מת ראשון ואחר כך מת האב ובעלי החוב

יחלוקו ובה״ בית הלל אומ׳ אומר הנכסים בחזקתן וכתובה
45 בחזקת יורשי הבעל ונכסים היוצאין וה
נכנסין עמה בחזקת יורשי האב:

אלו ואלו מודים שיחלוקו. אמ׳ אמר ר׳ רבי עקיבה
מודה אני בזה שהנכסים בחזקתן. אמר
15 לו בן עזאי על החלוקין אנו מצטערין אלא
שבאתה לחלוק עלינו את השוין:
