ולא הכירוהו והשיאו את אשתו. 7 ז׳ אמר רבי עקיבא כשירדתי
לנהרדעא לעיבור השנה מצאני נחמיה איש בדלא אמר לי שמעתי שאין משיאין
את האשה בארץ ישר׳ ישראל על פי עד אחד אלא יהודה בן בבא נימיתי לה וכן הדברים
5 אמר ליה אמור להם משמי אתם יודעי׳ יודעים שהמדינה הזאת משובשת בגייסות מקובל
אני מרבן גמליא׳ גמליאל הזקן שמשיאין האש׳ האשה על פי עד אחד וכשבאתי והרציתי הדברי׳ הדברים
לפני רבן גמליאל שמח לדברי ואמר מצינו חבר ליהודה בן אבא. ח׳
מתוך דברים נזכר רבן גמליאל שנהרגו הרוגים בתל ארזא והשיא רבן גמליאל
את נשותיהן על פי עד אחד והוחזקו להיות משיאין עד מפי עד ומפי אשה ומפי
10 שפחה. ט׳ רבי לעזר ורבי יהושע אומר אין משיאין את האשה על פי עד
אחד. רבי עקיבא אומר לא על פי אשה ולא על פי קרוביה. י׳ אמרו לו
מעשה בבני לוי שהלכו לצוער עיר התמרים וחלה אחד מהם בדרך והניחוהו ב
בפונדק ובחזירתן אמרו לפונדקית איו חבירינו נומת להם מת וקברתיו והשיאו
את אשתו אמרו לו לא תהא כהנת כפונדקי׳ כפונדקית אמ׳ אמר להם כשתהא הפונדקית נאמנת.
15 יא׳ הפונדקית הוציאה להן מקלו ומנעלו ותרמילו וספר תורה שהיה בידו׃
