1מי שקינא לה ונסתרה אפילו שמע מן העוף הפורח יוציא ויתן
30 כתובה דברי רבי אליעזר. רבי יהושע אומר משישאו ויתנו
בה מוזרות בלבנה. 2 ב׳ אמר עד אחד אני ראיתיה
שניטמאת לא היתה שותה. ולא עוד אלא אפילו עבד אפילו שפחה הרי אילו
נאמנין אף לפוסלה מכתובתה. חמותה ובת חמותה וצרתה ויבמתה ובת בעלה
הרי אילו נאמנות לא לפוסלה מכתובתה אמרו אלא שלא תשתה.
35 3 ג׳ שהיה בדין ומה אם עדות הראשונה שאינה אוסרה איסור עולם
אינה מתקיימת בפחות משנים. עדות האחרונה שהיא אוסרתה איסור עולם
אינו דין שלא תתקיים בפחות משנים תלמוד לומר ועד אין בה. כל שיש בה.
ד׳ קל וחומר לעדות הראשונה מעתה ומה אם עדות האחרונה
שהיא אוסרתה איסור עולם הרי היא מתקיימת בעד אחד. עדות הראשונה שאין
40 אוסרתה איסור עולם אינו דין שתתקיים בעד אחד. תלמוד לומר כי מצא
בה ערות דבר. ולהלן הוא אומר על פי שנים עדים או על פי שלשה עדים יקום
דבר. מה דבר האמור להלן על פי שנים עדים. אף דבר האמור כאן על פי
שנים עדים. 4 ה׳ עד אומר ניטמאת ועד אומר לא ניטמאת. אשה
אומרת ניטמאת. ואשה אומרת לא ניטמאת היתה שותה. עד אומר ניטמאת
45 ועדי׳ ועדים שנים אומרים לא ניטמאת היתה שותה. שנים אומרי׳ אומרים ניטמאת ואחד אומ׳ אומר לא
ניטמאת לא היתה שותה׃
