בעשרים ושלשה שנ׳ שנאמר השור יסקל וגם בעליו יומת. כמיתת הבעלים כן מיתת השור. הארי והזאב והדוב
והנמר והברדלס והנחש מיתתן בעשרים ושלשה. ר׳ רבי ליעזר או׳ אומר כל הקודם להורגן זכה. ר׳ רבי
עקיבה או׳ אומר מיתתן בעשרים ושלשה. 5 ה׳ אין דנין לא את השבט
5 ולא את נביא השקר ולא את כהן גדול אלא בבית דין שלשבעים ואחד. ואין מוציאין למלחמת
הרשות אלא על פי בית דין שלשבעים ואחד. ואין מוסיפין על העיר ועל העזרות אלא על פי
בית דין שלשבעים ואחד. ואין עושין סנהדריות לשבטים אלא בבית דין שלשבעים ואחד
ואין עושין עיר הנדחת אלא בבית דין שלשבעים ואחד. אין עושין עיר נדחת בספר ולא שלש
עיר נדחת אבל עושין אחת או שתים. 6 ו׳ סנהדרין גדולה היתה שֶלְ;
10 שבעים ואחד וקטנה שלעשרים ושלשה. מניין לגדולה שהיא שלשבעים ואחד שנ׳ שנאמר אספה לי
שבעים איש מזקני יש׳ ישראל . ומשה על גביהן הרי שבעים ואחד. ר׳ רבי יהודה או׳ אומר שבעים. ומניין
לקטנה שהיא שלעשרים ושלשה שנ׳ שנאמר ושפטו העדה והצילו העדה. עדה שופטת ועדה מצלת
הרי עשרים. ומניין לעדה שהיא עשרה שנ׳ שנאמר עד מתי לעדה הרעה הזאת יצאו יהושע
וכלב. ז׳ ומניין להביא עוד שלשה ממשמע שנ׳ שנאמר לא תהיה אחרי
15 רבים לרעות שומע אני שאמר היה עמהן לטובה. ואם כן למה נאמ׳ נאמר אחרי רבים להטות.
לא כהטייתך לטובה הטייתך לרעה. הטייתך לטובה על פי עד אחד ולרעה על פי שנים אין
בית דין שקול מוסיפין עליהן עוד אחר הרי כ׳ג׳ עשרים ושלשה . וכמה יהא בעיר ותהא ראויה לסנהדרין
מאה ועשרים. ר׳ רבי נחמיה אומ׳ אומר מאתים ושלשים כדי שרי עשרות.
