המבריך את הגפן בארץ אם אין עפר על גבה שלש׳ שלשה טפחים לא יביא זרע עליה אפי׳ אפילו הבריכה בדלעת או בסילון הבריכה בסלע א׳ע׳פ׳ אף על פי שאין עפר על גבה אלא שלש אצבעות מותר להביא זרע עליה הארכובה שבגפן אין 20 מודדין אלא מן העיקר השני
2ב׳ המבריך שלש גפנים ועיקריהן נראין ר׳ רבי אליע׳ אליעזר ב׳ר׳ בן רבי צדוק או׳ אומר אם יש ביניהם מארבע אמו׳ אמות עד שמנה הרי אלו מצטרפות ואם לאו אין מצטרפין גפן שיבשה אסור׳ אסורה ואינה מתקדשת ר׳ רבי מאיר או׳ אומר אף צמר גפן אסור ואינו מקדש ר׳ רבי אליע׳ אליעזר או׳ אומר אף על גבי הגפן אסור ואינו מתקדש
3ג׳ אלו אסורין ולא מקדשין מותר חורבן הכרם מותר מחול הכרם מותר פסקי עריס מותר 25 אפיפיירות אבל תחת הגפן ועבודת הגפן וארבע אמו׳ אמות שבכרם הרי אלו מקדשות
4ד׳ המסכך על גפנו על גבי תבואתו של חברו הרי זה קידש וחייב באחריותו
5ר׳ רבי יוסה או׳ אומר מעשה באחד שורע את כרמו בשביעי׳ בשביעית ובא מעשה לפני ר׳ רבי עקי׳ עקיבא וא׳ ואמר אין אד׳ אדם מקד׳ מקדש דבר שאינו שלו
6ה׳ האנס שזרע את הכרם ויצא מלפניו קוצרו ואפי׳ ואפילו במוע׳ במועד ועד כמ ׳ כמה הוא נותן לפועלים עד שליש יתר מיכן קוצר כדרכו והולך אפי׳ אפילו לאחר המוע׳ המועד 30 ומאמתי נקרא אנס משישקע
7ו׳ הרוח שעילעלה את הגפנים על גבי תבוא׳ תבואה יגדור מיד ואם ארעו אונס מותר תבוא׳ תבואה שהיא נוטה תחת הגפן וכן בירק מחזיר ואינו מקדש מאמתי תבואה מתקדש משתשליש וענבים משיעשו כפול לבן תבואה שיבשה כל צרכה וענבי׳ וענבים שבשלו כל צרכן אינן מתקדשות
8ז׳ עציץ נקוב מקדש בכרם ושאינו נקוב אינו מקדש בכרם ר׳ רבי שמע׳ שמעון או׳ אומר זה וזה אסורין ולא מקדשין 35 המעביר עציץ נקוב בכרם אם הוסיף מאתים אסור
